On September 24th, in Kunming city, Yunnan province, China, the 3rd Conference of People's Procuracy of provinces sharing the Viet Nam - China border was held with the theme: "Strengthening international cooperation in combating crimes in border areas". After a morning session, the Conference ended successfully, meeting the requirements and objectives set forth.
Ms. Ge Xiao Yan, Deputy Prosecutor General of the Supreme People's Procuratorate of China, and Mr. Nguyen Quang Dung, Deputy Prosecutor General of the Supreme People's Procuracy of Viet Nam co-chaired the Conference.
On the delegation of the Supreme People's Procuratorate of China side, there’re delegates from the Supreme People's Procuratorate, Military Procuratorate of the People's Liberation Army, National Migration Administration, Yunnan Provincial People's Procuratorate and Guangxi Zhuang Autonomous Region People's Procuratorate attended the Conference.
The delegation of the Supreme People's Procuracy of Viet Nam attended the Conference included delegates from the Supreme People's Procuracy; the High-level People's Procuracy in Ha Noi; the Central Military Procuracy; the People's Procuracies of Dien Bien, Lai Chau, Lao Cai, Ha Giang, Cao Bang, Lang Son, Quang Ninh provinces and the Military Procuracy of Military Region 1.
In her opening speech, Ms. Ge Xiao Yan, Deputy Prosecutor General of the Supreme People's Procuratorate of China warmly welcomed the leader and members of the People's Procuracy of Viet Nam’s delegation, who attended this meaningful Conference.
Ms. Ge Xiao Yan, Deputy Prosecutor General of the Supreme People's Procuratorate of China, said that in recent years, the People’s Procuratorate of China has comprehensively strengthened the handling of cases with foreign elements, implemented mutual legal assistance in criminal matters, and continued to actively cooperate internationally. In the process of judicial exchange and cooperation with neighboring countries, the Chinese Procuratorate always follows a friendly and proactive approach, thereby strengthening the traditional friendship between the People's Procuracy of Viet Nam and People's Procuratorate of China.
In addition, the Conference of People's Procuracy of provinces sharing the Viet Nam-China border is an important bilateral mechanism established under the attention and direction of the Prosecutor General of the two countries.
In 2017 and 2019, the first and second Conferences were held in the Guangxi Zhuang Autonomous Region of China and Quang Ninh Province of Viet Nam, respectively. Through those Conferences, the two sides have reached an understanding on strengthening cooperation in the prosecution of border localities of the two countries and achieved great results.
After a period of interruption due to the COVID-19 pandemic, this Conference aimed to implement the important common perception of the two countries' People's Procuracy and Procuratorate, to build an effective cooperation mechanism to combat transnational crimes, to maintain stability and peace in the region, to ensure economic and trade development between the two countries' borders, and to improve the effectiveness of mutual legal assistance in criminal matters.
On this occasion, Ms. Ge Xiao Yan, Deputy Prosecutor General of the Supreme People's Procuratorate of China, also made the following proposals: Continue to promote friendly exchanges and cooperation between the two countries' procuratorates and procuracy, especially in the fight against cross-border crimes; actively research and develop a mechanism to implement mutual legal ssistance in criminal matters more effectively; increase the level of training exchanges between prosecutors of the two countries; at the same time, promote the healthy development of the two countries' Procuratorates and Procuracy.
Ms. Ge Xiao Yan, Deputy Prosecutor General of the Supreme People's Procuratorate of China believes that through this Conference, the friendship and mutual understanding between the two countries' procuratorates and procuracy will certainly increase, thereby contributing to promoting and strengthening cooperation between Viet Nam and China.
In his speech at the Conference, Mr. Nguyen Quang Dung, Deputy Prosecutor General of the Supreme People's Procuracy of Viet Nam, expressed his delight at leading the Delegation of the People's Procuracy of Viet Nam to attend the the 3rd Conference of People's Procuracy of provinces sharing the Viet Nam - China border with the theme: "Strengthening international cooperation in combating crimes in border areas".
On behalf of the Delegation of the People's Procuracy of Viet Nam, Mr. Nguyen Quang Dung, Deputy Prosecutor General of the Supreme People's Procuracy of Viet Nam, sincerely thanked Ms. Ge Xiao Yan, Deputy Prosecutor General of the Supreme People's Procuratorate of China and her colleagues from the People’s Procuratorate of China for the warm and thoughtful reception given to the Vietnamese’s Delegation right from the moment the Delegation arrived at the border of the two countries.
Deputy Prosecutor General of the Supreme People's Procuracy of Viet Nam, Mr. Nguyen Quang Dung said that, implementing the Minutes of the 2nd Conference of People's Procuracy of provinces sharing the Viet Nam - China border signed on November 28th, 2019 in Ha Long city of Quang Ninh province of Viet Nam, after a period of interruption due to the COVID-19 pandemic, today, in Kunming city, the city known as the "Spring City" of Yunnan province of China, the People's Procuracy and People’s Procuratorate of the two countries has coordinated to organize the 3rd Conference of People's Procuracy of provinces sharing the Viet Nam - China border. This is an important event, marking the return of a practical and effective cooperation mechanism in the fight against crime, and is also a festival of solidarity and an opportunity to strengthen the cooperative relationship between prosecutors and officers working in the People's Procuracy sector of Viet Nam and China. The conference not only strengthens professional cooperation and enhances mutual understanding between prosecutors of the two countries, but also deepens the traditional friendship between the two agencies, thereby contributing to deepening the comprehensive strategic cooperative partnership between Viet Nam and China.
The Deputy Prosecutor General of the Supreme People's Procuracy of Viet Nam emphasized that Viet Nam and China are two neighboring countries with mountains and rivers connected by mountains and rivers. The friendly relationship between the two countries was cultivated by President Ho Chi Minh and President Mao Zedong and many generations of leaders of the two countries and has become a valuable asset of the peoples of the two countries. With the motto of "friendly neighbors, comprehensive cooperation, long-term stability, looking towards the future" and "good neighbors, good friends, good comrades, good partners", the comprehensive strategic cooperative partnership between the two countries has continuously expanded and deepened, becoming a solid foundation for Supreme People's Procuracy of Viet Nam, the Supreme People's Procuratorate of China and the local People's Procuracy and People's Procuratorate of the two countries to carry out cooperation activities in the fields of law and justice.
In addition, over the past years, the friendly cooperation between the People's Procuracy of Viet Nam and has continuously developed and achieved many positive results. The Supreme People's Procuracy of Viet Nam and the Supreme People's Procuratorate of China have focused on directing subordinate units to synchronously deploy cooperation activities, thereby achieving outstanding results.
Reviewing the outstanding results of friendly cooperation in organizing training courses, conferences, seminars, and cooperation in the field of mutual legal assistance in criminal matters; the Deputy Prosecutor General of the Supreme People's Procuracy of Viet Nam said that, with the encouraging cooperation results mentioned above, we are pleased to see that the Supreme People's Procuracy of Viet Nam, the Supreme People's Procuratorate of China and People's Procuracy of provinces sharing the Viet Nam - China border have seriously and effectively implemented the directions of the Prosecutor General of the two countries in the signed Memorandums of Cooperation; thereby, affirming that the establishment and development of a direct cooperation mechanism between the People's Procuracy of provinces sharing border between Viet Nam and China is necessary, correct, has practical significance, and actively contributes to improving the effectiveness of fighting and preventing crimes in border areas.
In addition to recognizing the good results achieved, the Deputy Prosecutor General of the Supreme People's Procuracy of Viet Nam also pointed out certain limitations and difficulties in the practical cooperation between the People’s Procuracy and the People’s Procuratorate of the two countries in recent times. In order to inherit and promote the achieved results, on the basis of existing lessons learned, to further enhance the effectiveness of cooperation in the coming time, the Deputy Prosecutor General of the Supreme People's Procuracy of Viet Nam made a number of recommendations, that is:
First, continue to make efforts to effectively implement the cooperation documents signed between the two sides; maintain the exchange of delegations of all levels from central to local to further enhance mutual trust and understanding, promptly exchange information, share experiences and overcome practical difficulties.
Second, continue to review, summarize and draw practical experiences, thereby proposing and recommending competent authorities to perfect the legal framework for mutual legal assistance in criminal matters activities between the two countries, especially research and develop a legal document to allow the implementation of a direct mutual legal assistance mechanism between the People's Procuracy of bordering provinces.
Third, promote the application of information technology and digital transformation in sending and receiving requests and additional documents in mutal legal assistance activities between the two countries to shorten the time to implement request for both sides. The specific implementation method is assigned to the two focal units.
Fourth, the Supreme People's Procuracy of Viet Nam and the Supreme People's Procuratorate of China will continue the organization of training in the field of mutal legal assistance to guide the conduct agencies to prepare documents in accordance with the procedures and with sufficient content in order to improve the quality of the documents, to ensure the fastest possible progress in implementing requests for mutual legal assistance and meet the requirements of timely combating crime.
The Deputy Prosecutor General of the Supreme People's Procuracy of Viet Nam, Mr. Nguyen Quang Dung believes that with the tradition of friendly cooperation in the spirit of "both comradeship and brotherhood" and the close coordination of the two countries' People's Procuracy and People's Procuratorate during the preparation process, the Conference will certainly be a great success, achieving the set goals.
At the Conference, the delegates listened to presentations from: the Supreme People's Procuracy of Viet Nam; the People's Procuracy of Ha Giang, Lao Cai, Quang Ninh provinces; the Supreme People's Procuratorate of China; the People's Procuratorate of Yunnan province; the People's Procuratorate of Guangxi Zhuang Autonomous Region; and the National Immigration Administration of China. The contents of the presentations clarified the cooperation results achieved between the Supreme People's Procuracy of Viet Nam and the Supreme People's Procuratorate of China; the situation of cooperation in crime prevention and control between the People's Procuracy and People's Procuratorate of the border provinces of the two countries; some limitations, difficulties, obstacles and proposals, recommendations and solutions to further improve the effectiveness of cooperation between the People's Procuracy and the People's Procuratorate of the two countries in the coming time.
