Seminar on measures to collect and evaluate electronic data, digital evidences in cases using high technology to commit crimes

On October 30, 2020, the Supreme People's Procuracy of Viet Nam in coordination with the German Foundation for international legal cooperation (IRZ) co-organized an online international seminar at two bridge points Viet Nam and German on "Sharing experiences between Vietnam and Germany on measures to detect, seize, preserve, evaluate, use electronic data, digital evidence in solving cases using high technology to commit crimes ".

Attending the seminar at Vietnam Bridge Point were Mr. Nguyen Quang Dung, Deputy Prosecutor General of the Supreme People's Procuracy, chair of the Seminar; representatives of a number of units under the Supreme People's Procuracy; representatives leaders and officer of the High-Level People's Procuracy in Ha Noi, People's Procuracy of Ha Noi, University for Prosecutors in Ha Noi; representatives of  Department of Internal Political Security (A03), Department of Foreign Exchange Security (A01), Office of the Investigation Police Agency of the Ministry of Public Security and the People's Police Academy.

Speaking at the opening of the seminar, Mr. Nguyen Quang Dung, Deputy Prosecutor General of the Supreme People's Procuracy, thanked the coordination of the German Foundation for International Legal Cooperation for actively support the Supreme People's Procuracy of Vietnam in the process of preparing and organizingthe online seminar. The Deputy Prosecutor General of the Supreme People's Procuracy stated that the seminar is a bridge to share experiences between Vietnamese procurators, investigators and German prosecutors on measures to detect, seize, preserve, evaluate, use electronic data, digital certificates in solving cases using high technology to commit crimes, to meet the requirements of improving efficiency the fight against high-tech crimes in both countries

Mr. Nguyen Quang Dung, Deputy Prosecutor General of the Supreme People's Procuracy said, in recent years, with the booming development of information technology, especially the Internet, high-tech crime has arisen and rapidly developed in Viet Nam. Criminal activities of subjects using high technology are becoming more and more common, increased sharply in the number of criminals and the number of cases with increasingly sophisticated tricks; the level and nature of the offenses are getting more and more complicated and serious, bearing the nature of organized crime and transnational crime. High-tech crime has been a big challenge for Viet Nam in particular and other countries around the world in general. However, the reality shows that detecting, capturing, recovering, preserving, evaluating and using electronic evidence often encounters many difficulties because offenders can quickly delete or correct the data to conceal the criminal acts; the offense is also not limited in space or time ...

Therefore, the strengthening of international cooperation to share information and experiences on seizing, preserving, evaluating and using electronic data, digital certificates with countries having strengths in developing achievements in criminal science and technology, especially digital, artificial intelligence, including the experience of colleagues from the Prosecutor's Office of the Federal Republic of Germany in the fight against crimes arising in the current deep integration context is very necessary.

The delegates and guests gathered to discuss main contents such as: The reality of high-tech crime in Vietnam; measures to collect, transform and use electronic certificates to prove in a crime case using high technology to commit a crime in accordance with Vietnamese law; difficulties in collecting electronic data to serve the investigation of high-tech crimes cases; the exploitation of electronic data, digital pieces of evidence, and relationships with other sources of evidence for accusation and litigation at court. In addition, the seminar also listened to the German experts sharing experiences of the Federal Republic of Germany on methods of detecting, capturing, preserving, evaluating, using electronic data, digital certificates in solving cases of using high technology to commit crimes

According to the experience shared by the German Federal Republic representative about the implementation of the audiovisual investigation measures and the evaluation of the results obtained, Mr. Andreas May, Chief Prosecutor of the Prosecutor General's Office Frankfurt am Main, Federal Republic of Germany commented: in Germany, the phonograms and video recordings are considered objects. When given at the hearing, these recordings are usually viewed live. Information is translated into readable form, the conversation is recorded in writing and is considered a testimony in written form. The seminar also listened to constructive discussions and questions from of Vietnamese representatives as well as the Federal Republic of Germany experts.

Mr. Nguyen Quang Dung, Deputy Prosecutor General of the Supreme People's Procuracy appreciate the results achieved after a period of discussion and discussion, has initially envisioned and compared the similarities and differences between the laws of Vietnam and the Federal Republic of Germany on electronic data and digital certificates; difficulties and problems of both Vietnam and the Federal Republic of Germany in the capture, preservation, evaluation and use of electronic data and digital evidences in the fight against hi-tech crime.

The Supreme People's Procuracy of Viet Nam wished to continue to strengthen cooperation with the Ministry of Justice of the Federal Republic of Germany in the coming time, and received the support of the German Foundation for International Legal Cooperation in opening training courses on professional skills to strengthen the capacity of Vietnamese officials and Procurators to meet the requirements of intensive international integration.
